CAC-522486 – Robert Rogers Vs. His Majesty the King

In January 2023, a jury convicted Mr. Rogers of second-degree murder and interference with human remains in the death of Colton James Cook. Second-degree murder carries a mandatory sentence of life in prison. A Nova Scotia Supreme Court judge then ruled that Mr. Rogers must serve at least 19 years in prison before he is eligible to apply for parole.

Mr. Rogers is appealing his conviction on the grounds the Supreme Court judge made errors when providing instructions to the jury about the testimony of the key Crown witness (known as a Vetrovec instruction). He is seeking a new trial.

This appeal hearing is scheduled for a half-day, starting at 10 a.m. on Tuesday, October 15, 2024. It will be heard by a three-member panel comprised of Justice David Farrar, Justice Anne Derrick, and Justice Robin Gogan.
